These Terms & Conditions govern your use of the services provided by Pelindung, a pension protection legal services firm registered and operating in Malaysia. By engaging our services or using this website, you acknowledge that you have read, understood, and agree to be bound by these terms. - "Pelindung" / "We" / "Us" / "Our"
- Refers to Pelindung, the pension protection legal services firm located at Level 11, Menara Northam, Jalan Sultan Ahmad Shah, 10050 George Town, Penang, Malaysia.
- "Service"
- Refers to any legal advisory, pension review, appeal preparation, or retirement protection service provided by Pelindung, whether accessed in person, by telephone, or through this website.
- "User" / "You" / "Your"
- Refers to any individual who accesses this website, submits an enquiry, or engages Pelindung for any Service.
- "Content"
- Refers to all text, materials, documents, forms, and information made available on this website or shared during the provision of Services.
- "Agreement"
- Refers to these Terms & Conditions together with any engagement letter or service agreement signed between Pelindung and the User.
Acceptance of Terms

Service Description
Pelindung provides pension protection legal advisory services in Malaysia, including but not limited to:
- Pension Entitlement Walkthrough — A review of EPF (KWSP) and pension records with a written summary and discussion of your entitlement position.
- Pension Claim Review and Appeal — Assessment, documentation, and measured appeal preparation for declined or miscalculated pension decisions.
- Complete Retirement Protection Plan — A thorough engagement coordinating entitlement review, appeal support, and survivor pension documentation for households managing multiple schemes.
Our Services are available to individuals residing in or subject to Malaysian pension and retirement legislation. We reserve the right to assess the suitability of any engagement before accepting instructions.
User Responsibilities
When using this website or engaging our Services, you agree to:
- Provide accurate, complete, and truthful information in all communications and documents submitted to us;
- Cooperate promptly and reasonably in the provision of requested documentation or information;
- Use this website only for lawful purposes and in a manner consistent with all applicable Malaysian laws;
- Notify us promptly of any changes to your personal circumstances that may affect your case;
- Not attempt to circumvent, disable, or interfere with any security or functionality of this website.

- Using any Content for commercial purposes;

Documents prepared by Pelindung specifically for your case remain your property once fully paid for, though Pelindung retains the right to retain copies for its records in accordance with professional obligations.
Payment Terms
All fees are quoted and payable in Malaysian Ringgit (RM). Current service fees are:

Payment terms will be specified in your engagement letter. We may require a deposit prior to commencing work. Accepted payment methods will be communicated upon engagement. Fees may be revised from time to time; revised fees will apply to new engagements only.
Refund Policy: As our Services involve professional time and legal work, fees paid for work already commenced are generally non-refundable. If you wish to discontinue a Service, please contact us in writing. Any refund consideration will be made on a case-by-case basis at our reasonable discretion, proportionate to work completed.
Service-Specific Terms
Each engagement is defined by the scope agreed in your engagement letter. Changes to scope may affect timelines and fees, and will be discussed with you before proceeding.
- Scope and Deliverables: Specific deliverables, timelines, and responsibilities are detailed in the engagement letter provided before work commences.
- Client Cooperation: Timely delivery of requested documents and information is essential. Delays caused by the client may affect projected timelines without constituting a breach on our part.
- Third-Party Decisions: Pelindung cannot control or be responsible for decisions made by EPF (KWSP), the Pensions Division, or any other government or regulatory authority. Our role is to assist in presenting your case clearly and professionally.
- Written Updates: Where included in your service package, updates will be provided in writing at reasonable intervals or upon significant developments.
Confidentiality
We treat all information you share with us with the highest degree of discretion. Pelindung will not disclose your personal or case information to third parties except where:
- Disclosure is required by law or a competent authority;
- Disclosure is necessary to carry out the Services you have engaged us for (e.g. submitting documents to EPF or the Pensions Division);
- You have given explicit written consent for disclosure.
Your confidentiality obligations: Information shared with you about Pelindung's processes, methodologies, or templates remains confidential and must not be disclosed or reproduced without our written consent.
Disclaimers
While we approach every matter with care and diligence, please note the following:
- No specific outcomes are assured. The outcome of any pension review, appeal, or claim depends on the facts of your case and the decisions of the relevant authority. We provide our best professional assistance, not a predetermined result.
- Website information is general. Content on this website is for general informational purposes and does not constitute legal advice specific to your situation.
- Third-party links. We are not responsible for the content, accuracy, or practices of any external websites linked from this site.
- Service availability. We reserve the right to modify, suspend, or discontinue any aspect of our Services with reasonable notice.
Limitation of Liability
To the fullest extent permitted by Malaysian law, Pelindung's aggregate liability to you for any claim arising from or related to these Terms or the Services shall not exceed the total fees you have paid to us in the three months preceding the claim.
Pelindung shall not be liable for:
- Indirect, consequential, or incidental losses arising from your use of our Services;
- Decisions made by government bodies, regulatory authorities, or pension funds;
- Loss arising from inaccurate or incomplete information provided by the client;
- Force majeure events including natural disasters, government actions, or service disruptions beyond our control.
Indemnification
You agree to indemnify and hold harmless Pelindung, its principals, and staff from any claims, losses, costs, or liabilities (including reasonable legal fees) arising from:
- Your breach of these Terms & Conditions;
- False, misleading, or incomplete information you have provided;
- Your violation of any applicable law or third-party rights.
Termination
By you: You may discontinue your engagement with us at any time by written notice. Fees for work already performed will remain payable.
By Pelindung: We may terminate an engagement with reasonable notice if circumstances make it professionally inappropriate to continue, or if you are in breach of these Terms. In such cases, we will advise you promptly and, where possible, assist with transition arrangements.
Survival: Provisions relating to confidentiality, intellectual property, limitation of liability, indemnification, and dispute resolution shall survive termination of this Agreement.
Dispute Resolution
Governing Law: These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia.
Jurisdiction: Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Penang, Malaysia.
Informal Resolution: Before initiating formal proceedings, we encourage both parties to attempt resolution through direct discussion. Please contact us in writing at [email protected] so that we may address your concern in good faith.
Mediation: If informal resolution is unsuccessful, either party may refer the matter to mediation before the Asian International Arbitration Centre (AIAC) or another mutually agreed mediator prior to litigation.
General Provisions
- Entire Agreement: These Terms, together with any signed engagement letter, constitute the entire agreement between you and Pelindung with respect to our Services.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Failure to enforce any right under these Terms shall not constitute a waiver of that right.
- Assignment: You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may assign our rights in connection with a business transfer.
- Notices: Formal notices should be sent in writing to our registered office or to [email protected].
Changes to Terms
Pelindung reserves the right to revise these Terms & Conditions at any time. When changes are made, the updated date at the top of this page will reflect the revision.
Continued use of this website or our Services following a change to these Terms constitutes your acceptance of the revised terms. We recommend reviewing this page periodically. For active engagements, material changes will be communicated in writing.
